Glider, EPA have absolutely no jurisdiction over how much income you can make from your animals. What they do have jurisdiction over is the time frame between purchasing and selling an animal, how many animals you buy/sell, how many of a single species you possess at any one time and what species you have.

The real story is that he was wild collecting large numbers of animals, pretending to breed them and sending them all interstate without filling out any paperwork this end ( by only dealing with states that did not require to an import permit number from him) .This is how all the hooded scalyfoots, burtons, asper etc. suddenly came to be available at the same time. They could not prove he was wild collecting but they could prove he wasn't breeding as most of his "breeders" were pairs of males. (this info comes from our local ranger).

Makes me wonder how they sexed the small lizards,tiaro pub in QLD had a big brown tree snake in a bottle that was identified by QLD NPWS as a taipan so the owner told me

I was ripped off to the tune of $1500- a few years ago by a man with the same name. He was in far nth Qld at the time and was to swap some birds with me but I never got mine, after sending some to him, he vanished. Hope they throw the book at him.

Jonno,

Not quite sure on the income part of your statement. While the EPA may not use income per se as a stand alone criteria to determine the commercialism of any particular 'venture'. You could be certain that it would form part of the EPA's brief of evidence in proving certain elements of the charges.

Put it this way, it is definitely not inadmissable under the rules of evidence and as long as that information was gained lawfully, there would not be a problem in the court accepting it as evidence.

Was at the Hide away hotel Tiaro,the owner said the NPWS identified it as a taipan,i had a close look at ,definately a really huge brown tree snake.That hotel has some good pics too of a big salty on the back of a cart,i met the guy that was in the photo and he said it was from the mary river,real queenslanders are interesting when you finally find one thats not from victoria or NSW. (or NZ )

Yeah, Simone and i have dined at the Hideaway Hotel many times and have seen the pics of the salty.

It was explained to me recently by EPA that you can only become a commercial seller if you sell exclusively those animals that are listed as commercially saleable. They could not offer any info on how much is to much, both dollars wise or animal number wise on a recreational licence. I would assume that if you are a private keeper/breeder that the issue of commercial gain would not be in there juristiction, it could be more a matter for the taxation department as to how much income you have gained from your hobby i am sure if they wish you to declare how much interest you have gained on a simple bank account that they would love to know your activity in reptile sales. i keep exclusive records on my movements so that i can show that any gain i have made from excess numbers has gone back into the hobby in the way of expenses and also new species that have been purchased. I am a bit paranoid that there are to many clauses, acts and precedences that no one can really give you one hundred percent that your activities are for a gain or not.

Safety in paper trails is my method. please correct me if anyone disagree's with what i have posted as this is just my experience.
