NSW Licenses - Advertising Changes

For those of you with NSW licences please be aware of changes that have been made to the advertising restrictions. I have only become aware of these since receiving my licence renewal. I would be interested in knowing if any other herp societies were aware of when these changes formally came into play.

Anyway, if you have an older licence (printed in blue I guess) your advertising clause (I think clause will read something like:

"The Licensee shall not advertise for the disposal or acquisition of protected fauna the subject of this licence, except in a publication of a society of keepers of fauna authorised to be held under this license of which the licensee is a member".

Clause 9 of my new licence now reads:

The licensee, if advertising the disposal or acquisition of protected native animals the subjest of this licence, may only advertise such animals for disposal or acquisition in a publication of a society of keepers of animals authorised to be held under this license of which the licensee is a member, or in a specialist publication, journal or internet site related to the keeping of the animal. In all cases the licensee shall state the following in such an advertisement when advertising the disposal or acquisition of protected native animals:
a) The holders Native Animal Keepers license number
b) That the protected native animals involved are only available for purchase or disposal to the holder of a current Native Animal Keepers' Licence or other relevant licence authorising the possession or disposal of those protected native animals"

This is a good move in that it confirms a practice that has been going on for many years. But note that it does not mention advertising in pet shops and I would not expect that Petlink is seen as a specialist site related to keeping reptiles. But it is up to the department to rule on Petlink by either contacting people who advertise there telling them that it is illegal to do so or by continuing to do nothing therefore making it legal by their inactivity.

From APS's point of view we need to add NSW to that bit at the bottom of our for sales section so that all NSW licence holders add their licence number to their adds. We should also have as a standard clause that animals can only be sold to persons with a relevant licence (and let the Victorians selling blue tongues etc to remove it).

So if I wanted a Blue Tongue from someone in NT or VIC, I wouldn't be able to purchase it as it is exempt from licensing and isn't on that keeper's license? And this goes for all animal species that are exempt from being recorded on licenses all AU?

Are you saying we should have our licence numbers stated on our adverts?

Yes Kane, you are exactly correct. You can have similar problems in SA. Thats why Mac Herps has put forward that if we allow exempt species you still need a licence to keep them, you just don't have them recorded in your books. so, if you want to buy a blue tongue (on the assumptin they become exempt), the person shows you their licence, you show them yours and the transaction takes place without paperwork.

All in all however, it just shows how ludicrous it is to have separate legislation and regulations in each state.

ok I read condition 9 part B differently. If you are selling a blue tongue to someone in vic or wherever there on an exempt list you certainly allowed too as long as you have an export permit and they have an import permit. This is covered under other relevant licenses authorising the disposal. Even though they have an exempt list they still need an import / export permit to move things interstate.

If we get an exempt list in NSW it would be pointless still requiring a license to keep them. All that I believe would be needed is for the source to issue and keep a copy of a receipt like that is required under condition 3.
