I just saw an ad on ebay for a vivarium including a reptile, a bluetongue.

Is this legal?
 
The ad specifically is selling the viv, with the bluetongue included.

It says nothing about licencing, but is in Victoria.
 
I don't think it is against any laws, but it is against ebays polices.
 
So hypothetically speaking, what is the legality if the person who wins the auction does not have a licence?

Is the seller obligated to give the animal to the winning bidder? Or does he risk consumer legalities if he doesn't hand the animal over to a winning bidder who has no licence?
 
I would imagine that the law would weigh more then a policy on ebay. But, I think he'd get into trouble, assuming he has no licence.
 
It could get messy depending on where the winner of the auction lives.
I would nearly put money on that the seller doesn't have a licence, not an issue in vic though
