Looks like an ornata to me, where was the photo taken?
 
Do you hav a more focused shot of the head scales ? That wld giv a certain ID...
 
SE Qld? Probably not ornata then, maybe a slightly abberant diadema.
 
it is not at my place and i was lucky to get that.. I think her cat killed it :( she was worried about the cat :|
 
Furina diadema - red naped snake is native to se qld. pic is identical to specimen in my book.
Furina ornata - orange naped snake is NOT native to se qld.
 
I say red naped snake (Furina diadema).
Here is one i saved a while ago, I reckon it is a dead ringer for yours.

i live in south east qld, and have never seen one..

could you give me details about where it was found? (not a specific place) just want a bit of an idea

They are located from Pt Augusta in South Australia to Cairns in Qld they occupy a wide range of habitats and climates a full grown adult only reaches about 400-500mm in length. You probably have never seen one because they are so small. They are very easily missed.
