Pet shops allowed to sell in nsw, why can't I sell on gumtree?

Hey guys, whenever I put a reptile up on gumtree they delete the ad within a few days. I enquired and they said reptiles cannot be sold on gumtree in nsw. I'm thinking this has to do with the pet shop laws? But now pet shops are allowed to sell reptiles I don't see why gumtree

why does it say only a limited number of species in relation to what individuals can own in nsw? Or is that just limited to what shops can sell?

In Queensland pet shops are only allowed to sell some species and the snakes are antaresia species only but we are allowed to sell any sort on gumtree.
 
I know that NPWS were threatening posters on some FB pages with action a few months ago after they placed ads.....I cannot recall the full details but something about licence conditions stipulating that herps could only be advertised in official journals of herpetology clubs. I know one site (admin of a FB page where a person was cautioned) that sought clarification from NPWS and never got a response.

Maybe NPWS have been threatening Gumtree?
 
Petlink.com.au stopped advertising reptiles for sale a few years ago. Why not join your local herp society to advertise your surplus animals? :)
 
Just found it....Under Section 9 of General Conditions of your NSW licence:

"The licensee, if advertising the disposal or acquisition of protected native animals the subject of this licence, may only advertise such animals for disposal or acquisition in a publication of a society of keepers of animals authorised to be held under this licence of which the licensee is a member, or in a specialist publication, journal or internet site related to the keeping of the animal. In all cases the licensee shall state the following in such an advertisement when advertising the disposal or acquisition of protected native animals:
a) The holder’s Native Animal Keepers’ Licence number;
b) That the protected native animals involved are only available for purchase or disposal to the holder of a current Native Animal Keepers’ Licence or
other relevant licence authorising the possession or disposal of those protected native animals."

I am guessing that either your ad did not comply with a) or b), or Gumtree have been contacted by NPWS and told that they do not meet the criteria to include reptiles in NSW in their classifieds (I would probably suggest the latter given the recent history that I am aware of).

 
Cheers guys, that clears everything up! I was just acknowledging on the ads that I had a licence and writing licence number TBA. Now if I sell anything, I will just do it on here :) sick of dealing with people who have no clue about reptiles and do not understand the full requirements for husbandry, and for some species, demanding requirements.
Interesting about these laws to do with pet shops and only being allowed to sell certain species. I was hoping one day, many moons away, I could start my own reptile store and I would want to sell monitors ect. It's my dream to work with reptiles, I'm still not sure if I could deal with selling my reptiles to people who may not be able to give them the best life possible and at the very least meet all the reptiles requirements, so it can at least have a chance.
i guess I would have to have a long talk with the customers that are new to helping and let them know that proper lighting, supplements, food, and enclosure sizing is not optional but necessary if you want to buy a reptile from my store.
 
It could also be due to personal beliefs of the editor on Gumtree. They deleted my ad for frozen rats saying that they don't allow the sale of pets for food. I don't know of anyone that keeps frozen rats for pets? Maybe the ill-informed should rename the site to Dumbtree.

There is heaps of reptiles for sale on gumtree from Queensland so it must be a state regulated thing.

Yep, its a NSW law. It should be made national due to all the non licenced people i see trying to see their reptiles here is SA.

Or atleast make it so you need to apply for a gumtree account using permit numbers that are checked by governing bodies for herps in each state. I reckon 95% of adds in SA dont show a permit number.

You better be joking mate haha. Oh well I guess there is some good info in all those legislation documents that comes with the lisence. :)

I know reptiles are available on gumtree in other states.
but seriously tiliqua, how can you compare someone who doesn't provide a descent standard of living for there animal with someone who doesn't know if reptiles can be sold on gumtree? Even though gumtree is a horrible place to sell, it is convenient and lots of people see the ads.

I think it is up to the owner of the animal to make sure it goes to a good home and gets the care it needs.

as to unlicensed people selling animals on gumtree, there are some horror stories but I'm not so much as concerned about them not having the license but whether they are giving the animal the proper requirements. I myself only got a license a few months ago and I've been herping for a while lol and I looked after my animals probably just as if not better than those on a license, at the time I just didn't see the point of paying the government when I didn't need to..
Now I understand though that the license is very helpful for buying/selling legally and is quite important. I think it's wrong to say non licensed herpers and people who don't look after there herps properly go hand in hand, even though in most cases it does.

Because understanding the animals husbandry requirements is equally important as understanding the laws giving you the privilege to keep them.
Why should I read a firearms licence's conditions if I already keep it in a safe and know how to pull the trigger?

The first thing I do when I renew my licence is read it to ensure there are no new rules I may not be compliant with. There haven't been many changes to the licence that affect me in the 15 years I've been licensed, but the selling of reptiles through herp societies has been there since the licensing system came in (altered in recent years to include herp-related websites).

Anyhow I couldn't find anything in the T & C that was against frozen animals and sent a please explain email. The admin sent me back an email that said it was inappropriate and could be offensive to those that keep them as pets. :what:
 
Read what you Licence say.. Specific groups or Breeders .. Gumtree is like the Newspaper and you cant sell them in the paper.

This is something people keeping them as pets needs to accept and move on. They are part of the cycle of life just as other animals are. Like feeding chickens or rabbits to crocs or big pythons, fish to sharks or other sharks. Just another feeder animal in my opinion.

So what I didn't read the entire license details, stop trying to bully people, you've already made your point and now you are just repeating yourself, you don't really have anything else to say to me lol. Firearms can kill people, completely different
 
It's a ludicrous, outdated law that was implemented before the internet and horse- drawn carts.

I find it a little funny that NPWS has that license condition yet uses the exact same avenues to list their ballots.....NPWS logic.

Oh, sorry, I was just answering the question directed at me, then you got upset I answered it.

I would stick to herp-related sites of reptile publications for advertising. Gumtree has a bad name when it comes to selling reptiles, there's been plenty of threads in the past with disappointed buyers. Kinda like the newer version of what 'petlink' used to be.
